IPCPR Says metropolis City Council Badgered by Well-Funded Anti-Tobacco Forces

Discussions at Monday’s meeting of the metropolis City Council are expected to include doable expansion of the city’s smoking ban and both sides of the issue are actively campaigning for their respective positions — especially the anti-tobacco forces.
“Nobody likes to state anything negative about the American Cancer Society, but they are pouring money on a problem that doesn’t exist and their contributors should question how they are spending their money,” stated Chris McCalla, legislative director of the International Premium Cigar & Pipe Retailers Association.
The Cancer Action Network of ACS recently mailed full-color brochures against secondhand smoke to local citizens. McCalla states the material misrepresents the issue because “contrary to their twisted tall tales, evidence overwhelmingly supports the benign nature of incidental exposure to secondhand smoke.”
The IPCPR represents some 2,000 retailers and manufacturers of premium cigars, including Dallas-based Up In Smoke cigar stores, the ownership of which is urging its customers to attend Monday’s meeting in opposition to the proposed extension of the smoking ban.
“The Surgeon General’s report is consistently misrepresented regarding the effects of secondhand smoke the evidence of which the report found ‘inconclusive. The Occupational Safety and Health Administration does not position secondhand smoke as a significant workplace issue. A report on secondhand smoke by the Environmental Protection Bureau was vacated and declared null and void by a federal court because it misrepresented false conclusions that were based on poorly conceived and badly executed research… and so on,” McCalla said.
“But the anti-tobacco forces repeat their lies about secondhand smoke so often that the public has accepted them as the truth. It was Mark Twain who stated ‘There are three kinds of lies: lies, shit lies and statistics.’ Those anti-smoking groups concoct secondhand smoke statistics to suit their purposes and use illogical arguments to defend their otherwise indefensible positions,” stated McCalla.
He also cited the Fifth Amendment to the Constitution of the United Says as giving business owners the right to decide whether or not to grant smoking on their premises and for employees and customers to have the right to work or patronize these businesses.
“Piece by piece, governments are taking away our constitutional rights. Smokers and non-smokers alike in Texas and everywhere should effort against all such efforts,” added McCalla.

The metropolis City Council has delayed until December 3 a vote on whether or not to broaden the current smoking ban. Meanwhile, the International Premium Cigar & Pipe Retailers Association recommends that they also think about eliminating the ban entirely.
“Let’s not automatically adopt that the Council can only leave the ban as it is or make it more restrictive. There is another substitute and that is to do away with it completely,” stated Chris McCalla, legislative director of IPCPR.
McCalla pointed out that smoking bans are usually based on two issues: misrepresented claims of harm done by secondhand smoke and a lethargic public that doesn’t care if its rights are taken away from them. In response, he states that claims regarding secondhand smoke are usually false, business suffers and individualized rights guaranteed by the United Says Constitution are trampled on.
“Throughout the 707 core pages of the 2006 Surgeon General’s report, it states no less than 108 times that the evidence is insufficient regarding the health impact of secondhand smoke, yet anti-smoking forces have twisted that report and others to suit their needs. Even the Occupational Health & Safety Administration doesn’t regard secondhand smoke a significant workplace issue anywhere. Finally, the wild claims regarding secondhand smoke by an Environmental Protective Bureau report were severely criticized as biased by the Congressional Research Service and the report was finally vacated and declared null and void by a Federal judge,” stated McCalla.
McCalla also cited a report by the Heartland Institute that “… studies have shown that smoking bans injured small businesses…. In Ohio, for example, the Department of Job and Family Services predicted a 10,000-job acquire for the state’s hospitality and leisure industry prior to the ban’s implementation. In reality, the industry lost 5,400 jobs during the first 12 months of the smoking ban,” according to the Institute’s report.
The Constitution states less is more when it comes to government control, stated McCalla.
“Business owners should have the right to declare whether or not smoking should be granted on their premises. Employees and customers should have the right to work or patronize those businesses. But when the government tells business owners how to run their businesses, smokers and non-smokers alike should be up in arms over the prospects of another Constitutional right being taken away from the citizens of Texas,” McCalla said.
